“狗屎记者”是对记者的名誉侵权吗？
那么，老塔称记者为“狗屎”是不是对记者的名誉侵权？1993年，《最高人民法院关于审理名誉权案件若干问题的解答》规定：“以书面或者口头形式侮辱或者诽谤他人，损害他人名誉的，应认定为侵害他人名誉权。4名誉权是指公民和法人对其名誉所享有的不受侵犯的权利。名誉权是法律直接赋予的公民或法人的重要人格权，是公民或法人赖以存在并能从事民事活动的基本条件之一。名誉权的特征表现在专有性，人身性和不可侵犯性等三个方面。是否构成名誉侵权，可从三个方面进行分析：
一是它具有法律上能够确认贬损他人名誉的性质。对记者的评价，只能是社会中占主导地位的道德价值观念。这种“能够确认”的“主流价值观”，不会认为记者是“狗屎”。“狗屎记者”在公众中会产生两种影响，一是认为记者品性有问题，人是狗屎。二是记者的作品是狗屎。这种侵害行为造成的损害性后果，足以使当事人“记者”受到公众“不公正”的对待，如被鄙视、蔑视或歧视。
三是行为必须是指向特定人的行为。塔瓦雷斯一直强调，重庆的足球记者中有一些是“狗屎记者”，现在他的打击面又在扩大，说每个城市中都有两三名“狗屎记者”，这种侮辱记者们都忍受了，没有人骂老塔是“狗屎教练”，直到他疯狂的拳头砸向记者的脸。6而令人奇怪的是，老塔在说，每个城市有狗屎记者的时候，有几名重庆记者听在耳里，但都没有作声。7去年8月份，当时是在力帆与中远赛后的新闻发布会上，老塔当着所有中国记者的面说：“中国的媒体是全世界最糟糕、最差劲的媒体，中国的记者没有一个是正直的人，他们所写的每一篇文章都是谎话连篇……”8 从上面的描述，老塔的行为已有所指，特定的记者，重庆的记者，每个城市的记者，中国的记者。真的.，老塔与中国媒体交恶由来已久。
记者遭遇侵权，谁来为记者维护权利？一是记者要恪守职业道德，避免新闻侵权。要进行客观报道，不要以个人的好恶去报道某个事件。由于工作不慎出现了新闻侵权，要争取主动，取得当事人的谅解。二是记者要通过各种手段维护自己的权益。三是报社和记协要积极维护记者的权益。如记者个人不能维护自身的权益，报社和记协是记者的娘家人，一定要维护记者的合法权益。在老塔登门向王印毅道歉、力帆俱乐部对其进行罚款3000元，作为对王印毅身体和精神的赔偿。现在双方争论的焦点是塔瓦雷斯应否向王印毅公开道歉。当事人王印毅本人表示，自己已经接受老塔的登门道歉，赔偿的3000元由报社转捐给希望工程。《重庆晚报》认为此事已不在是当事人双方的事，此事应由报社和俱乐部协商解决。如俱乐部处理不妥当的话，《重庆晚报》将诉诸法律。9四是要形成用法律维护权益的社会氛围。“老塔欧记”事件发生以后，“私了”的声音不断，正是这种“私了”的恶习，纵容和包庇了侵害记者的事件的不断升级，从骂“狗屎记者”到打记者。而对肇事者的处理，也是轻描淡写。最高人民法院院长肖扬曾提出为新闻单位提供司法保护的6条原则。10新闻记者在进行舆论监督时，被诬告、被陷害、被攻击，人民法院应该坚决保护记者的正当权益。为此，运用法律手段才能有效保护记者的合法权益不受侵犯，在全社会形成切实维护记者权益的良好氛围。维护记者合法权益，才能申张社会正义。
